How Palmdale's ADU rules got here
2020Local ordinance adopted. Following statewide AB 68 and AB 881, the City Council adopts Ordinance No. 1539 on April 7, amending PMC 17.91.010 to align with the new state framework.
2021HCD finds multiple compliance gaps. A June 29 findings letter identifies several problems: an "existing structure" definition limited to buildings at least two years old, an overbroad street-side setback requirement, missing "where feasible" flexibility language, a JADU septic-connection rule that exceeded state authority, and a ban on second-floor ADUs lacking exterior stairways. The city is asked to respond by July 30.
2024Owner-occupancy ban made permanent. AB 976, effective January 1, permanently prohibits California cities from requiring owner-occupancy for ADUs.
2025State flags an outdated ordinance. A December 5 HCD technical assistance letter notes the most recent ordinance on file for Palmdale is still the 2020 version, and that numerous state law changes since then may have left it out of compliance.
2026A new, more detailed findings letter arrives. On February 11, HCD issues formal written findings identifying several unresolved compliance problems: outdated statutory citations following a 2024 renumbering, an unlawfully narrow one-ADU-per-lot cap, the 800 sq ft multifamily-lot size restriction, the prohibited deed-restriction requirement, missing fire-sprinkler language, and an outdated JADU owner-occupancy rule. The city has until March 10 to respond with a plan to amend the ordinance or formally defend it.
