Zoning & size requirements

What you're allowed to build

ADU typeMax sizeMax heightNotes
New construction, detached or attached 1,000 sq ft, a flat cap regardless of bedroom count 16 ft (up to 18 ft within a half-mile of a VTA light rail station); max 2 stories Simplified from the old bedroom-based size tiers by Ordinance No. 3240-25 (April 2025)
Conversion of existing space (garage, basement, in-law unit) No size cap Same as the existing structure Building permit only, no separate planning permit required
Junior ADU (JADU) 500 sq ft Same as the primary structure Built within the existing walls of the home; combinable with an ADU
Allowed zoning districts

ADUs are permitted on lots zoned R-0, R-1, R-2, and Residential DSP (Design/Site Plan) districts, citywide. A qualifying single-family lot can now hold up to three total units, the primary home plus an ADU and a JADU, under the city's April 2025 ordinance rewrite. Confirm your parcel's zoning with the Community Development Department.

Additional standards

Setbacks, parking & other rules

Setbacks4 ft side and rear for new detached construction; front setback follows the underlying R-0/R-1/R-2 zone, though it can't be used to block an 800 sq ft ADU under state law
ParkingNone required. Sunnyvale doesn't impose an off-street parking requirement on new construction, conversions, or JADUs, going beyond what state law requires cities to waive
Units per lotUp to 3 total units on a qualifying single-family lot (primary dwelling + 1 ADU + 1 JADU); multifamily lots follow state law, including up to 8 detached ADUs under SB 1211
Owner-occupancyNot required for ADUs, permanently eliminated statewide by AB 976 effective January 1, 2024. JADUs generally still require the owner to occupy either the primary residence or the JADU, per state law.
Building codeMust meet the California Residential Code as locally adopted by Sunnyvale
Traffic Impact FeeApplies to ADUs of 750 sq ft or larger, charged at the multi-family rate and calculated proportional to the unit's size relative to the primary dwelling; ADUs under 750 sq ft are exempt under state law
Ordinance history

How Sunnyvale's ADU rules got here

Worth knowing: Sunnyvale's original 2021 ordinance drew one of the longer HCD findings letters we've come across, flagging 11 separate non-compliant provisions. Rather than patch the ordinance piecemeal, the city fully repealed and rewrote Chapter 19.79 in April 2025, and the result is now one of the more generous ADU ordinances in the region, with no local parking requirement at all and a flat size cap that doesn't penalize larger units.

Permit process

How Sunnyvale ADU permitting works

1

Pre-application check

Confirm your zoning district and whether your project qualifies for the building-permit-only path (800 sq ft or under, or a conversion) with Community Development.

2

Prepare your plan set

You'll need a site plan, floor plans, and elevations for the ADU; conversions should also include floor plans of the existing structure.

3

Submit your application

ADUs at or under 800 sq ft, conversions, in-law units, JADUs, and basement units need only a building permit, with no separate planning permit.

4

Ministerial plan review

State law requires a decision within 60 days of a complete application; the permit is deemed approved if the city misses that deadline.

5

Building permit & inspections

Pull your building permit, begin construction, and schedule the standard framing, plumbing, electrical, and final inspections.

Because Sunnyvale doesn't require a separate planning permit for most ADUs, the building-permit review is often the whole process. Fees and timelines are approximate - confirm current figures with the Building Safety Division.

Budgeting

What it costs to build an ADU in Sunnyvale

Garage conversionRoughly $90,000-$200,000, the least expensive path since the shell already exists
New detached ADURoughly $180,000-$400,000+ for a code-compliant, freestanding unit; Silicon Valley land and labor costs push Sunnyvale toward the top of the statewide range
Traffic Impact FeeApplies at 750 sq ft and up, calculated proportionally at the multi-family rate; confirm the current per-unit figure with the city
Plan check & building permit feesValuation-based rather than a flat citywide number; budget a meaningful line item on top of construction cost and confirm the current fee schedule with Building Safety

These are general ranges from local contractor estimates and regional reporting, not quotes - actual cost depends heavily on lot conditions, finishes, and site access. Sunnyvale sits in the heart of Silicon Valley, home to major tech employers, and that same land and labor market that drives up home prices also drives up ADU construction cost.

FAQ

Common questions

Do I need to live on the property to build an ADU in Sunnyvale?
No. California's AB 976 permanently eliminated owner-occupancy requirements for ADUs statewide as of January 1, 2024. Junior ADUs generally still require an on-site owner.
How many ADUs can I build on one lot?
A qualifying single-family lot can hold up to 3 total units: the primary home, an ADU, and a JADU. Multifamily lots follow state law, including up to 8 detached ADUs on qualifying existing multifamily properties under SB 1211.
Do I need extra parking for an ADU?
No. Sunnyvale doesn't require off-street parking for new construction, conversions, or JADUs of any size.
How long does the permit process take?
State law requires a ministerial decision within 60 days of a complete application, and the permit is deemed approved if Sunnyvale misses that deadline. Many smaller and converted ADUs need only a building permit, which can move faster still.
What's the maximum size for a new-construction ADU in Sunnyvale?
1,000 sq ft, a flat cap that applies regardless of bedroom count, with a 16 ft height limit (18 ft within a half-mile of VTA light rail). Conversions of existing space have no size cap.
How much does an ADU cost to build in Sunnyvale?
Garage conversions tend to run roughly $90,000-$200,000, and new detached units roughly $180,000-$400,000 or more, based on local contractor estimates and regional reporting. A locally imposed Traffic Impact Fee applies on top of that for units 750 sq ft and larger.
Was Sunnyvale's ADU ordinance ever found non-compliant with state law?
Yes. HCD flagged 11 non-compliant provisions in the city's original 2021 ordinance in a December 2022 findings letter. Sunnyvale responded by fully repealing and rewriting its ADU chapter in April 2025 (Ordinance No. 3240-25), and the current rules go beyond several state minimums, including dropping any local parking requirement.
Why is ADU demand so strong in Sunnyvale?
Sunnyvale sits in the heart of Silicon Valley, near major tech employers, and carries some of the highest housing costs in the country. That combination makes an ADU's rental income potential and multigenerational-housing value especially significant for homeowners here.
Can I rent my Sunnyvale ADU out short-term?
Short-term and vacation rentals are regulated separately from standard rentals in many California cities. Confirm current short-term rental rules with the city before finalizing your plans if that's part of your strategy.
